BOISE, Idaho (AP) - The Idaho Supreme Court has upheld a plan by officials in Rexburg to use property tax money to build a $6.3 million water park in a decision that will likely affect urban renewal districts throughout the state.
The court ruled unanimously this week to uphold a lower court ruling rejecting a challenge by Rexburg resident Kenneth Hart.
Hart challenged the legality of the Rexburg urban renewal district using Madison County property tax revenue to pay for building Riverside Park. He contended the urban renewal district was an "alter ego" of the city and that such projects require two-thirds voter approval.
But justices ruled urban renewal districts aren't alter egos of cities and therefor voter approval wasn't needed for the urban renewal district to raise the money.
