
Todd ChismSPOKANE, Wash. - A judge in Stevens County has ruled in favor of Spokane Firefighter Todd Chism's request to release information that could clear his name and tell his side of the story.
In open court Tuesday, defense attorney's say prosecutor David Turplesmith admitted that WSP experts did not find child porn on the hard drive confiscated when Chism was arrested. Chism was taken into custody in January on charges of possessing child pornography.
Washington State Patrol investigators made the arrest and confiscated Chism's computer as evidence. A judge released Chsim at his first appearance saying there was not enough evidence to hold him. Defense attorney's were able to get a mirror image of Chism's computer hard drive which they say also showed no signs of child pornography. Chism has said all along that he and his wife were victims of identity theft and their stolen credit card was used to purchase the pornography.
The state is still actively pursuing Chism's work computer from Station 16, to check for pornography. Chism and his attorney's are expected to make a statement sometime Tuesday or Wednesday.
