    SPOKANE, Wash. - It was one horrible crime, but two very different beliefs of how it went down. Police suspect the victim, 13-year-old Russell Evans, was run over by a hit and run driver. His body was found in the middle of the road. Some believe it was an accident and the driver fled the scene. Others say this was something much more sinister. "He was just a kid, he didn't deserve to die in the street," said Russell's cousin Chris Rosenau.

He never could have known, it would end up being the final night of his life. "It was a Sunday morning," said Bill Floyd. "My wife and I were upstairs sleeping. I heard banging on the door. They wouldn't go away."

"It's a rural farming community, logging community," said Tim Besst with the Latah County Sheriff's Office. " Everybody knows everybody, so even your friends, you treat them like family too."

"I don't want to be walking down the street and knowing the person is free and out there," said Angie's daughter Brittney Ducrest.

Because of that, his killer has gone free for 37 years. The victim's head was injured so badly, his skull was cracked and his head was partially severed. Police suspected he may have been a transient.

    SPOKANE, Wash. - It all started with an employee at the North Spokane landfill moving debris back in July of 1989. As they were working, they saw a human leg entangled in garbage. Police were called and the victim was found, but never identified. Investigators believe the garbage the remains were found in had been at the dump for roughly two to the three weeks. It's referred to as a possible homicide, but because his body was is such a state of decomposition, they can't be sure.

Aguirre was facing a murder charge in the 1986 cold case murder of a Spokane prostitute but court documents filed Thursday in Spokane County tell us those charges have been dropped due to lack of evidence. Earlier this year Aguirre was found not guilty of sexual assault in Franklin County.
