Magistrate allows inmate to leave jail for Thanksgiving

SPOKANE, Wash. – He has a criminal history stretching decades. He is days from accepting a plea deal that could send him to jail for 6 years and his court record cites at least 75 times he has failed to appear for a court hearing, but 52-year-old Terrence Kinard could be home for Thanksgiving thanks to a magistrate in US Federal Court.

Defense attorneys asked the court to allow the man out of jail for five hours next week as his family gathers in Spokane.

"Of significant concern for Mr. Kinard and his siblings is the health of their 80-year-old mother," according to a motion filed by his defense attorney.

The US Attorney's office didn’t contest or oppose the motion, saying the man doesn’t have a history of violent crimes.

The judge heard the motion earlier this week and ruled Tuesday, ordering Kinard to pay for two guards to watch him during the five hours away from the Spokane County Jail.

"Defendant may be released to two sworn law enforcement officers, prepaid and off-duty, at 10 a.m. Thanksgiving Day," wrote Judge Imbrogno, in an order signed November 17, 2009.

The judge ordered that Kinard must pay for the officers.  

Court documents allege Kinard bought cocaine from an undercover agent in November 2008. A plea hearing is scheduled in that case in early November. Attorneys are recommending more than 6 years of jail time.
