Driver in fatal motorcycle accident could face third strike

SPOKANE, Wash. - The driver of a motorcycle that was involved in an accident that led to the death of his passenger would face his third strike if convicted of Vehicular Homicide.

Lamont Brooks, 29, was driving his motorcycle between 50 and 70 miles per hour, according to witnesses, on 5th when a car pulled into the intersection ahead of him. Police say because Brooks was going so fast he was unable to stop the motorcycle in time and the motorcycle went to the ground, throwing both Brooks and his sister, 33-year-old Phyllis Darrough, from the bike.

Darrough suffered serious injuries and was taken to the hospital where she later died. Brooks suffered only minor injuries.

Police originally arrested Brooks on charges of Vehicular Assault, but during a search, Police found cocaine and charged him with Possession of a controlled substance. He was able to post the $15,000 bond on the original charges with a court appearance set for April 20.

After the death of his sister, Traffic Investigators amended the Vehicular Assault charge to Vehicular Homicide. The drug charge was also changed with a new charge of Possession of Cocaine with Intent to deliver.

Should Brooks be convicted of the Vehicular Homicide, it would be his third strike with two prior convictions, one for First Degree Assault and one for Second Degree Assault.
