COEUR D'ALENE, Idaho. - First District Judge Benjamin Simpson has refused to downgrade a first-degree murder charge for a man accused in a Coeur d'Alene shooting death.

Defense attorneys for 22-year-old Juan Carlos Villanueva asked the judge Wednesday to reduce the charge to voluntary manslaughter. Villanueva has yet to enter a plea to the first-degree murder charge.

Prosecuting attorney Barry McHugh says Villanueva planned to kill Timothy Williams, who also used the last name Wolfe, after the two had an altercation inside a local bar. Williams was shot to death early May 9 on a Coeur d'Alene city street.

Witnesses say Wolfe and his friends were at a local bar, Mik-n-Mak's, when Wolfe had a verbal altercation with Villanueva before management asked Villanueva to leave.

few hours later, at closing time, Wolfe was walking near 3rd and Indiana when Villanueva pulled up in his car and fired one shot from a pistol striking Wolfe in the head. Villanueva immediately fled the area. Wolfe was transported to Kootenai Medical Center and was later pronounced dead.

Villanueva was arrested later that day after police learned where he worked and arrested him there.

Eventually, Sierra and Josh Davies were arrested for it. Josh remains in the Spokane County Jail, facing 22 charges ranging from theft to money laundering. Sierra is facing brand new charges: prostitution.
