Spokane County Deputy's Shooting Called 'Murder'

SPOKANE, Wash. (AP) - New information about the fatal shooting of a Spokane Valley nursery owner leads his son to accuse a sheriff's deputy of murder.

Alan Creach says his 74-year-old father Wayne Scott Creach had complied with a deputy's command to back away from his car. Creach refused to drop the gun he had taken with him Aug. 25 to check on a suspected prowler, but he put it in a waistband. Creach also refused to get down on the ground.

Investigators said Tuesday that Deputy Brian Hirzel struck Creach in the knee with his baton to knock him down, then fired when he saw Creach reaching for the gun.

Alan Creach told The Spokesman-Review his father was within his rights, protecting his property. Creach calls his father's shooting murder.
