UPDATE: Moses Lake Burglary/Shooting

EPHRATA, Wash. - The following is an update regarding Sunday's burglary/shooting incident at 4301 Ottmar Road NE #5, Moses Lake.

The deceased has been identified as Joshua Montano, 30, of Moses Lake.

The home's occupant, Timothy Mandelas, already facing one count of unlawful possession of a firearm, faces a second count of unlawful possession of a firearm since there was a second firearm, a .22-cal. handgun, found inside the home. That .22 handgun was seized by investigators.

Mandelas identified a .45 caliber pistol located in the home as the one he used to shoot the alleged intruder (Montano).  That firearm is in possession of the Sheriff's Office.

Mandelas will also be charged with possession of marijuana with the intent to deliver since he was in possession of more than two pounds of marijuana. Although Mandelas has a legitimate medical marijuana card, he was in excess of the maximum amount he can legally possess under state law (1.5 lbs.) and he admits selling the marijuana to other medical marijuana card holders, which the law does not allow.

Mandelas remains uncharged on any crimes related to the shooting itself at this time.
