Investigation Complete In Reported ‘Bullying’ At Garry Middle School

SPOKANE, Wash. – It was a story that sent shock waves through our community - and created a firestorm online. What was first reported to be a severe case of bullying at Garry Middle School on May 16th, has turned into what Spokane Public School District officials call an ‘assault' case – not bullying.

School officials tell KHQ a district security officer spent a day and a half investigating this case. She reviewed surveillance video and conducted nine interviews with witnesses. The findings show both 8th grade boys (who KHQ is not naming) were verbally arguing, when the student who ended up with a concussion threw the first punch. The other student flipped him onto the ground, where he suffered head trauma.

Because of privacy laws, district officials cannot say whether either student is suspended or facing other disciplinary action at Garry Middle School. But district security officials say no probable cause was found to make an arrest in the case.

"If there had been probable cause for an arrest, based on a day and a half of investigation, somebody would have gone to jail," Security Department Supervisor Mark Howard told KHQ.

Once the school's investigation was complete, the case was sent to juvenile court. Prosecutors do not plan on filing charges.
