Frat House Fall Lawsuit Against The University Of Idaho Dismissed

MOSCOW, Idaho (AP) - The University of Idaho says it's pleased by a judge's decision to dismiss a suit by a former student who fell from a frat house window during an off-campus party.
    
Amanda Andaverde of Caldwell and her parents sued the school after the 19-year-old sophomore suffered a traumatic brain injury in the fall from an upper story window during a Sigma Alpha Epsilon frat house party.
    
In a statement, the university called her injury "a tragic accident."
    
An attorney for the family argued that the university was liable for Andaverde's injuries because it oversees the fraternity and sorority system. A lawyer for the university countered that school officials can't control what students do on private property.
    
The university recently rejected a proposed $1 million settlement.
