PRESS RELEASE FROM THE SPOKANE VALLEY POLICE DEPT: On Monday February 4th at approximately 2:40
p.m., Spokane Valley Sheriff's Deputy Mark Holthaus was out on patrol in the
area of 4th and University when he observed a defective brake light on a 1997
Ford Escort and the passenger of the vehicle was not wearing his seatbelt.
Deputy Holthaus activated his emergency lights to conduct a traffic stop and
contacted the driver and passenger. When he contacted the passenger, later identified as 22-year-old Gabriel C.
Ashby, stated he didn't have identification on him but he did verbally identify
himself with the last name of Spear and a birthday in January of 1990.
Deputy
Holthaus checked the name given by Ashby and was unable to locate any record. He re-contacted Ashby who gave a different spelling of "Speer" and stated he was
22-years-old even though with the date of birth previously given, he should be
23. Deputy Holthaus checked the new information and again found no record.
Due to these inconstancies, Deputy Holthaus detained Ashby and conducted a
pat search for weapons, locating a set of "brass knuckles" in Ashby's pocket. After being informed he was now under arrest for possession of a dangerous
weapon and of his rights, Ashby stated he carried the weapon for protection and
provided his real name and date of birth.
A check of Ashby's correct name
revealed an active felony warrant for Possession of a Controlled Substance out
of Newport, WA.
Ashby was transported to the Spokane County Jail and booked on the warrant
and charged with Possession of a Dangerous Weapon, a misdemeanor.
The driver was released at the scene.
