NAMPA, Idaho (AP) - A 34-year-old Caldwell man who was shot during an argument with his wife has died at a Salt Lake City-area hospital.

Canyon County spokesman Joe Decker says Samuel Ireland died Saturday.

Paige Ireland was initially charged with aggravated battery and use of a deadly weapon in the commission of a felony. The prosecutor's office is awaiting autopsy reports to decide if the charges should be changed.

Court records say Paige Ireland told investigators she was packing some belongings to leave because her husband was verbally and physically abusive. She said she grabbed her husband's hunting rifle to scare him into leaving her alone.

She did not believe the gun was loaded. She told investigators her husband yelled at her to shoot him and she pulled the trigger, intending to scare him. She called 911.
