Posted: Updated:

KOOTENAI COUNTY, Idaho - The Kootenai County Sheriff's Office has concluded its investigation into an injury crash at occurred on January 27, 2013 that sent the driver and his three year old daughter to the hospital.

On January 27, 2013 at about 3:30 PM, deputies responded to Avondale Loop and Miles
Ave, near the City of Hayden Lake for an injury crash. Once on scene, deputies found Timothy J. Freund standing outside his wrecked vehicle, holding his three year old daughter in his arms. His car had impacted head-on into a large tree off the side of the road.

Both Freund and his daughter had obvious injuries; Freund's hands were bleeding and there was a contusion to the child's head. Initially Freund refused medical assistance for the both of them. However, while speaking with Freund, the deputy smelled an "overwhelming" odor of an alcoholic beverage coming from him and began a DUI investigation.

A short time later, the deputy took Freund into custody for DUI. His daughter was initially
transported to Kootenai Health for a possible head injury and later transferred to Sacred
Heart Medical Center in Spokane. Freund was transported to the Kootenai County Jail, but
then complained of other injuries. He was transported to Kootenai Health for treatment as
well as a legal blood draw to determine his level of intoxication.

The KCSO Traffic Team determined the cause of the collision was a direct result of Freund's
impairment. Both Freund and his daughter have been released from the hospitals.
Freund's BAC was found to be .32, four times above the legal limit.

On February 19, 2013 the complaint against Freund charging him with Felony Injury to a
Child, Felony Aggravated DUI and Felony DUI was presented to the Honorable Judge
Caldwell, where he found probable cause for the felony charges and issued a warrant of
arrest for Freund, setting his bond at $50,000 upon his arrest.

Freund's criminal history includes two prior arrests in 2009 for DUI and Leaving the Scene
of a Crash, a 2007 arrest for Boating Under the Influence, and a 2007 arrest warrant for DUI.
