Posted: Updated:

BILLINGS, Mont. (AP) - A 36-year-old man who pleaded guilty to punching a 10-year-old boy who was trying to keep the man from attacking his mother has been given a three-year deferred sentence for felony assault on a minor.

The Billings Gazette reports (http://bit.ly/ZpQDaI) District Judge Gregory Todd on Tuesday gave Thomas Joseph Mascarena the sentence recommended in his plea agreement with prosecutors. Todd also ordered Mascarena to serve a concurrent suspended sentence and pay a $550 fine for misdemeanor partner or family member assault.

Mascarena was charged for a Jan. 22 fight in which a woman said her boyfriend forced his way into her house, pushed and hit her and then punched her son when the boy grabbed Mascarena's jacket to pull him away.
