Lawyer's Illness Delays Philly Abortion Trial

PHILADELPHIA (AP) - The defense is expected to get under way Tuesday in the capital murder trial of a Philadelphia abortion provider.
    
Seventy-two-year-old Dr. Kermit Gosnell is charged in the overdose death of a patient and in the deaths of seven babies allegedly born alive.
    
The defense has argued that there were no live births at Gosnell's Women's Medical Center, and that the woman died in 2009 of unforeseen complications.
    
Former staffer Eileen O'Neill is also on trial. The 56-year-old Phoenixville woman is charged with practicing medicine without a license, and taking part in a corrupt organization.
    
She may call character witnesses Tuesday.
    
But first, defense lawyers are expected to ask that the charges be dismissed for lack of evidence after the five-week prosecution case. Such motions are routine but rarely granted.

PHILADELPHIA (AP) - A defense lawyer has fallen ill, causing a delay in the murder trial of Philadelphia abortion provider Kermit Gosnell.
    
The 72-year-old Gosnell is charged with killing a patient and seven babies.
    
The defense had been expected to start presenting its case Monday after five weeks of prosecution testimony.
    
The trial is now scheduled to resume Tuesday if defense lawyer Jack McMahon is back to work.
    
McMahon has argued that there were no live births at the clinic, and that the 41-year-old patient died of unforeseen complications in 2009.
    
The only co-defendant, unlicensed doctor Eileen O'Neill, is charged with racketeering and working without a license. Her lawyer says she worked under Gosnell's supervision.

PHILADELPHIA (AP) - After five weeks of prosecution testimony, the defense begins Monday in the murder trial of Philadelphia abortion provider Kermit Gosnell.
    
The 72-year-old Gosnell is charged with killing a patient and seven babies.
    
Former clinic workers have testified that Gosnell taught them to snip the spines of aborted babies to make sure they had died.
    
The defense denies that any babies were born alive. And lawyer Jack McMahon has suggested the 41-year-old woman died of unforeseen complications.
    
It's not clear if Gosnell will testify before the jury gets the case.
    
Eight clinic employees have pleaded guilty, some to third-degree murder.
    
The only co-defendant, unlicensed doctor Eileen O'Neill, is charged with racketeering and working without a license. Her lawyer says she worked under Gosnell's supervision.
