Colville Boy Accused In Plot To Kill Classmates Ordered To Undergo Evaluation

COLVILLE, Wash – The 11-year-old boy charged in a plot to kill classmates at Fort Colville Elementary School in February has been ordered to undergo a competency hearing at Eastern State Hospital.

The boy is facing charges of conspiracy to commit first-degree murder, tampering with a witness, and juvenile in possession of a firearm.  Two weeks ago, his 10-year-old co-defendant pleaded guilty to all counts, and his sentencing is set for May 7th.

The boys are charged with bringing a knife, gun, and ammo to school, with the plan of raping and killing a 5th grade girl they go to school with, and up to seven other students.  The plan was foiled as school began on February 7th, when a fellow student saw the knife fall out of a backpack.  The attack was set to happen just hours later at first recess.

At an earlier capacity hearing, both boys were found capable of knowing the difference between right and wrong, overcoming a Washington law that presumes people under the age of 12 aren't capable of committing a crime.

However, the upcoming competency hearing is a separate matter.  It relates to the ability to aid in your own defense and understand the nature of the charges and proceedings against you.

Washington law says you can be found incompetent "as a result of mental disease or defect," according to RCW 10.77.010(15).

In earlier proceedings, there has been some question as to whether the 11-year-old old suspect may have a psychiatric disorder, and now his state of mind will undoubtedly take center stage.

The families of both boys have been present at each court hearing so far.

The 11-year-old suspect is due back in court May 13th.
