UPDATE: Spokane murder suspect Joshua Tillery is in custody, according to the Spokane Police Dept. He was located at about 11:15am on Wednesday at a residence in the 2000 block of N. Ruby. As soon as we learn more details we'll post them here on KHQ.com, Facebook and our Twitter news feed.

SPOKANE, Wash – Spokane Police announced Monday afternoon an arrest warrant has been filed for Joshua Tillery, 33, on a charge of 2nd degree murder in the shooting death of Devon Mack, 33.

The shooting happened at a home in the 4500 block of North Lincoln around 5:30p.m. Friday, and the major crimes unit was there for hours to investigate.

"We had detectives working on it all weekend, we interviewed everyone we believe was at the scene except for Mr. Tillery," Lt. Mark Griffiths told KHQ Monday.

Newly released court documents show that Tillery and Mack got into a fight at that home, and Tillery said, "Don't make me shoot you."

Another woman at the house went outside to call police, and reported hearing a gun shot.  When she came back in, Mack, known as "D-Mac" to his friends, was dead on the ground and Tillery was standing next to him with a black pistol.

Tillery reportedly said that he didn't mean for the gun to go off, and then told another woman at the home, Tara Rader, "You have to get me out of here."

Rader and Tillery left the scene of a shooting in a 2006 Pontiac Grand Prix, and Tillery was seen still holding the weapon.

Police later identified both Rader and Tillery as people of interest in the case.  They have since contacted Rader, and she is not facing any charges at this point.

"Down the road we may look at charges, but right now our focus is Mr. Tillery as our prime suspect in this case," Lt. Griffiths added.

Spokane Police told KHQ they believe Tillery is still in the Spokane area, and may be hiding with friends or family.  He has a lengthy criminal history in California for possession of a stolen vehicle, vandalism, possession of drugs, DUI, and possession of stolen property.  He is currently wanted in Washington on a misdemeanor weapons violation – in addition to the new murder charge.

Police would not comment on the relationship between Tillery and Mack.

They believe Tillery is dangerous, and are hoping he will turn himself in.  If you see him, call 911.
