WENATCHEE, Wash. (AP) - A Chelan County District Court Judge has thrown out breath test results in a drunken driving case because of an error by a Wenatchee police officer.
Officer Jordan Orrell had driver Cameron V. Adams blow seven times into two different detectors then reported only the last two measurements - .159 percent and .161 percent. The legal limit in Washington is .08.
The Wenatchee World reports (http://bit.ly/1137DTf) Judge Roy Fore agree Tuesday the tests were tarnished in part because Orrell failed to wait a required 15 minutes between each attempt.
Prosecutors could still offer other evidence of drunken driving from the traffic stop last January. Adams was pulled over for driving at night without headlights and failed roadside sobriety tests.
