UPDATE: Second Mistrial For Accused Rosalia Murderer

COLFAX, Wash. - Daniel Lazcano is accused of helping his brother Frank Lazcano Jr. kill Marcus Schur in December of 2010. For two days the jury deliberated the fate of Frank Lazcano, coming back on Monday with a hung jury. Lazcano was released from custody pending the possibility of a third trial. Lazcano was on trial facing kidnapping & murder charges.

Prosecutors tell KHQ's Dylan Wohlenhaus that the 9 day trial was the longest Whitman county has seen in more than a decade. Prosecutors say they believe they "have the right guy" despite two mis trials. Prosecutors have 90 days to determine if Lazcano will be tried a third time. Prosecutors say they have not yet made that decision.

KHQ's Dylan Wohlenhaus also spoke to Eric Christianson, Lazcano's defense attorney. He says that he is "hopeful" that Lazcano will not be tried a third time and he believes his client is innocent of any crimes he's accused of. Christianson says "factually & legally this is a very tough case" and is not surprised this came to another mis trial. "There are so many holes in the case, i'm surprised the jury keeps hanging it. I would think we would win it." Christianson says about the trial.

A jury convicted Daniel's brother, Frank Lazcano Jr. of murder in March and he was sentenced to 25 years in prison. For
