UPDATE: Deadly Shooting On I-90 Ruled Justified

In a press release sent out Tuesday evening, the Shoshone County Prosecuting Attorney has issued a decision concerning the June 12, 2013 officer-involved shooting in the death of Alexander Mandarino, of Montana. 

The Prosecuting Attorney, Keisha Oxendine, says she has reviewed the reports from the Kootenai County Sheriff's Office, and the assigned team of the Critical-Incident Task Force, as well as the dashboard audio and video of Trooper Todd McDevitt, Idaho State Police and Deputy Adam Durflinger, Shoshone County Sheriff's Office. Based on the evidence, Oxendine has stated that her conclusion is that the actions of Trooper Todd McDevitt, Idaho State Police, were justified. 

Oxendine says Mandarino posed an "immediate and continuing danger to the officers on scene, more specifically, Trooper McDevitt and Deputy Adam Durflinger, Shoshone County Sheriff's Office."

The release continues to state that "the circumstances in this case evidence that Trooper McDevitt and Deputy Durflinger were presented with a viabale threat of deadly force by Mandarino, through the presentation of a firearm by Mandarino and his refusal to release the firearm despite Trooper McDevitt's repeated demands and despite the trooper's attempt to struggle with Mandarino over the firearm. Under these circumstances, the use of deadly force by the Trooper in response to Mandarino's actions in this case is justified."

 

UPDATE: The Kootenai County Sheriff's Office has released the name of the suspect in Wednesday's shooting incident. Alexander L. Mandarino, age 26 from Whitefish, MT was the individual involved in the incident. His family has been notified.

An autopsy was performed Thursday afternoon; results are not available at this time. Toxicology reports will not be available for 6-8 weeks.

PRESS RELEASE FROM THE KOOTENAI COUNTY SHERIFF'S OFFICE:

On June 12, 2013 at just before 12:00 PM, the Shoshone County Sheriff's Office responded to Interstate 90 at about milepost 73, about 2 miles west of the Idaho/Montana border, to check the welfare of a motorist parked in an eastbound turnout.

Once the deputy arrived on scene, an Idaho State Trooper stopped to assist. During the contact with the occupant of the car, he was found to be in possession of a handgun. A struggle ensued and during the struggle, the ISP Trooper fired his service weapon, striking the male.

The suspect, a white male in his twenties, was transported to Shoshone Medical Center where he succumbed to his injuries. At this time, the male hasn't been positively identified. An autopsy will be scheduled at a later time.

The multi-agency Critical Investigative Team was requested for the investigation, with the Kootenai County Sheriff's Office being the lead agency.

Both the trooper and deputy are on administrative leave per their department protocols. They were not injured in the incident.
