PLOT TO KILL CLASSMATES: Colville Boy Appears In Court

COLVILLE, Wash. - On Monday an 11-year-old Colville boy accused in a plot to kill classmates appeared in court.

The judge denied the defense team's request to lower the bond because of how serious this case is.

A mental health evaluation showed concerns about the 11-year old's  attention span, but says there is no reason to not move forward with the case. 

The forensic mental health evaluation was done by Dr. Beaver - the third professional to evaluate the boy.

His defense attorney, Don Richter, plans to file a motion to suppress the boy's confession at trial. At this point, it's expected to last 2-3 days in mid-August.

The 10-year-old co-defendant has already been sentenced to 3-5 years in a juvenile detention facility for his role in the plot.

COLVILLE, Wash. – On Monday, the 11-year-old boy charged in a February plot to kill fellow classmates at Fort Colville Elementary School, was ordered to undergo a mental evaluation. A Boise-based doctor is being brought in to complete the evaluation, focusing on three things: competency, diminished capacity and sanity. 

In short, the essential question is whether the 5th grader understands the charges – and proceedings – against him.  In earlier court proceedings, there has been discussion as to whether the boy may have bi-polar disorder, and depending on what the doctor finds, the defense may decide to enter a plea of not guilty by reason of insanity.  

The 11-year-old suspect, along with a 10-year-old classmate, is being charged with conspiracy to commit first-degree murder, tampering with a witness, and juvenile in possession of a firearm. Both boys were arrested after a fellow student saw a knife fall out of a backpack on February 7th, and reported it to a teacher. Staff also found a gun and ammunition, and a detailed 7-step plan on how to carry out the killings was later revealed.  

The results of the mental evaluation should be discussed at the Stevens County Courthouse when the boy is back before a judge in two weeks. In the meantime, the 10-year-old boy also charged in the case will be sentenced for his role in the plot Wednesday afternoon. 

Prosecutors are asking for a lengthy jail sentence under a legal provision called ‘manifest injustice,' which says that because of the seriousness of the allegations, the boys at the center of this case should remain in jail until age 21.  The 10-year-old boy has pleaded guilty to all charges.
