UPDATE: Mother Hit By Car While Crossing Monroe With Kids Could Face Charges

SPOKANE, Wash. - Court documents released Tuesday say that the mother who attempted to cross a street with her two young children amidst oncoming traffic was under the influence of meth. Police are saying the mother could possibly be charged with 2nd degree manslaughter for the death of her 5-year-old daughter who passed away from her injuries, however they also say she may also not be charged at all.
Sarah M. Burrows-Gust, 25, was crossing Monroe between Mansfield and Montgomery just after 8pm on October 18th with her 5-year-old daughter and 7-year-old son. All three were struck by a driver who was unable to see them in the dark conditions.

Sarah Burrows-Gust and her daughter, Elayna Burrows-Gust were both transported to Sacred Heart Medical Center with life-threatening injuries.  Evan Burrows-Gust was transported to the hospital with non-life-threatening  injuries.  Elayna, 5, passed away on Saturday.
 
Burrows-Gust was being investigated at the time of the accident by CPS for child neglect involving domestic violence and drug use. She remains in the hospital but her condition is improving.
 
Two witnesses who saw the accident said that Burrows-Gust stepped off the curb with a child on each side of her attempting to cross the street where there was not a crosswalk.
 
Court documents say witness Michele Lee said to another witness, "What is that lady doing walking in the roadway with cars coming?"  Court documents also state Lee thought the car was traveling 30 to 35 mph.
The driver of the car, Bonnie L. Harland, 67, said she did not see the pedestrians until she was right on top of them and did not even have time to brake. She said she was going the speed limit of 30mph.

UPDATE:

People have been coming to the intersection of Monroe and Mansfield to pay there respects to a 5 year old girl killed after being hit by a vehicle while walking with her mother.  The accident happened at 6:30 Friday night.

According to police, a mother and her two children ages 5 and 7 were crossing the street when they were hit by a car.  The  intersection is not very well marked,  just three lines on the pavement, and it's a very busy intersection. All three were taken to the hospital, the little girl did not survive. Jamie Gavras, a woman who witnessed the accident and says she was the first to rush over to help the family after the crash...

"Obviously being one of the first people that was there, I've had lots of contact with the family. I spoke with the husband of the family just a little bit ago, the little boy was released, but the mom is still in critical condition at Sacred Heart."

Right now, Spokane Police Traffic Investigators are still trying to piece together exactly what happened. We do know that the mother and her two young children were crossing Monroe Street when they were hit by a station wagon. Police have not said why the driver didn't stop for the family, but those who live in the area say the crosswalk is very hard to see.

As for the driver, police say he is cooperating with officers and at this time. He has not been charged with anything. Police do not think drugs or alcohol are involved, but the investigation is still ongoing. The names of those involved have not yet been released.

UPDATE:

A mother and her two young children were struck by an oncoming vehicle while crossing Monroe Street.

The 5 year old female child was transported to the hospital and pronounced dead this morning.

The mother was transported to the hospital  with life-threatening injuries.

The 7 year old male child was transported to the hospital and is expected to survive.

The driver of the vehicle is cooperating with police and has not been charged.

Investigation into this incident is ongoing.

UPDATE:

Authorities tell KHQ that a 5 year old walking with their mother had died after being hit by a vehicle on Monroe and Mansfield yesterday.  Reporter Lindsay Nadrich is working to gather more details.

Driver of this vehicle believed to be involved in the accident is being interviewed by detectives.  Authorities tell us, the mother and one of her children sustained life threatening injuries.  Her other child has serious injuries.

A major incident has closed down Monroe at Mansfield.

Witnesses say a mother and two children were struck and the driver fled after the crash on foot. All three were taken to the hospital with unknown injuries. Monroe is shutdown at Mansfield as officers process the scene. Driver has not been located.
