CHENEY, Wash. - The driver who caused Saturday's crash near Cheney on Highway 904, injuring his 8-year-old son, made his first appearance in court Tuesday.

The driver, 47-year-old Curtis Cooley was taken to Sacred Heart along with his 8-year-old son after the crash. Cooley had minor injuries from the accident, but his son was initially in critical condition. KHQ spoke to the boy's mother. She says her son is now doing extremely well and is expected to make a full recovery.

Once Cooley was he was released from the hospital he was then booked into the Spokane County Jail for vehicular assault. Cooley is no longer in custody, but made his first appearance in court Tuesday. KHQ spoke to the other driver, Cooley hit nearly head on about what happened.

"I was looking at the road, I turned my head to see all the traffic in this lane and then I looked back and it was boom, it was right there," said crash victim Raquel Caballero. "It was really quick."

According to court documents, Curtis Cooley told Washington State Patrol he pulled out into the other lane on Highway 904 to pass a bus. It goes on to say that he does not really know what happened, but he could not bet back into his lane in time to avoid hitting the car Raquel Caballero was driving.

Caballero says the crash was not directly head on because she was able to turn just a little bit before the other car hit her. However, the impact sent her car flying and both cars are totaled.

Also in court documents, it says Cooley told WSP he had been drinking at a tailgate and even admitted to officers that his driving was impaired. KHQ spoke to his wife who says Cooley does not remember having that conversation with police.

Cooley had minor injuries after the crash, but his 8-year-old son lost consciousness at the scene and was rushed into surgery for a tear in his intestines at the hospital according to a nurse at Sacred Heart.

The 8-year-old boy was in critical condition initially, but according to his mother he is now doing very well and is expected to make a full recovery. Right now, he remains at Sacred Heart Hospital.

Caballero, the other driver, says her biggest concern after the crash was for the little boy.

"It just makes me so mad because I would never drink and drive," Caballero said. "It sucks that he would do that with his child in the car. That was what worried me the most about the situation was the little boy because I heard that they lost him for a little bit during surgery, so that was my main concern."

Cooley will make his next appearance in court on November 25, 2013. In the meantime, he is not allowed to have any contact with the victims and witnesses of the crash, excluding his son.
