In the 911 tapes obtained by KHQ Thursday afternoon, Fagan tells the dispatcher, "he said you don't want to do this right now i just got out of jail and he showed an ankle bracelet." The converstation with the 9-1-1 operator goes back and forth for a few minutes giving a description of black man wearing a dark jacket.>>

And are now in a waiting game until we hear back. They have given us no information as for how long the wait we be though.">>

    Gonzaga students Dan McIntosh and Erik Fagan have now acquired their weapons that were taken from them by campus security four hours after they fended off a home intruder on October 24th.

SPOKANE, Wash. -

After considering all of the information presented, the appeals board upheld the original ruling by the University Disciplinary Board that puts students Dan McIntosh and Erik Fagan on indefinite probation for a weapons policy violation.

The students were punished by Gonzaga after using a gun to fend off an intruder who was trying to enter their apartment. According to university policy, weapons are prohibited on campus or at any university residence.

The students live at a university residence off campus.

He was traveling South on Bowdish near 17th when he lost control of his car, uprooting a tree in the front yard of a home.
