Barry Beach Clemency is Denied

DEER LODGE - The Board of Pardons and Parole denied Barry Beach's reapplication for executive clemency Wednesday. The vote was unanimous.

Chairman Mike McKee said the board members submitted their own rationale for the decision to accept or deny the clemency application. McKee stated that the claims of new evidence are unreliable and not credible and that 30 years in prison is not an "extraordinary" sentence to serve for a murder conviction.

"This was a difficult application to review due to a myriad of additional factors Beach included in his application which we felt necessary to consider," said Chairman McKee, "The board members carefully reviewed all the information and listened to public omment before reaching their decision."

Governor Bullock released the following statement: “I’m disappointed with the Board’s decision.  Since Mr. Beach committed his crime as a juvenile, served over 30 years and conducted himself appropriately both inside and outside of prison, I believe there’s a strong argument for him to remain under state supervision as a parolee.”

Tim Fox also released a statement regarding the decision: "In denying Barry Beach’s fourth application for clemency, the Montana Board of Pardons and Parole board made a thorough, thoughtful, and correct decision. Prior state attorneys general, the Montana Supreme Court, and four separate decisions from the Board have all concluded that Beach is guilty and should remain in prison to serve the rest of his sentence. This unanimous decision reaffirms the fairness and effectiveness of Montana’s justice system. Thirty-five years after the murder of Kim Nees, Montana’s law enforcement community hopes this matter can now be finally laid to rest, and that Kim Nees’ family can heal, find peace, and move on."

Beach is serving a 100-year sentence for the 1979 murder of Kim Nees and is seeking to be eligible for parole.
