Supreme Court lifts ban on same-sex marriage in Idaho: local reaction

COEUR D'ALENE, Idaho - UPDATE:
Governor Butch Otter released a statement on the Supreme Court overturning Idaho's ban on same-sex marriages:
“The Supreme Court's order lifting Justice Kennedy's stay effectively allows same-sex marriage in Idaho as soon as the 9th Circuit directs compliance with its decision. I disagree with the court's conclusion, which negates the 2006 vote of the people of Idaho, is contrary to the values of most Idahoans, and undermines fundamental states' rights.  But we are a nation of laws. Idaho now should proceed with civility and in an orderly manner to comply with any forthcoming order from the 9th Circuit.”

The roller coaster that is known as same sex marriage in Idaho has finally come to an end. The U.S. Supreme Court lifted the ban late Friday afternoon.

This comes after the Supreme Court issued a stay on Wednesday on the same sex ban after the 9th court of appeals overturned it on Tuesday.

Governor Butch Otter, in a press release after the stay had been issued, said, "I will continue to work for the Idaho constitution and the mandate of Idaho Voters who stood by traditional marriage." Otter is referring to a 2006 vote in which the public decided to amend the state constitution to ban gay marriage, civil unions, and domestic partnership. Otter also said the 9th court of appeals had taken way the state's right to define marriage.

Former civil law professor and current member of the Kootenai County Human Rights Task Force, says marriage bans are being overturned across the country because they are in direct conflict with the 14th amendment in the U.S. Constitution, which states; No state can enforce a law that would abridge the rights of an American citizen.

"They're making it very clear, since all the circuit courts are agreeing that those bans are unconstitutional. It's obvious that this continues to move to more and more states to start granting license for marriage," says Stewart.
