SPOKANE, Wash. - The Spokane County Prosecutor's Office has determined that Spokane Police Officers Sean Wheeler, Art Dollard, John Roys and Kevin Keller were justified in shooting robbery suspect Stephen Corkery on March 26, 2014.

On that day, Spokane Police responded to a residence at 1527 W. Grace, where Corkery was reported to be staying. The police had probable cause to arrest him for a series of violent offenses including several armed robberies.

When police arrived at the house, they repeatedly asked Corkery to come out with nothing in his hands. Corkery did not cooperate and several officers reported that Corkery seemed to be carefully looking at where officers were located and seemed to be carefully sizing up his next move.

Corkery eventually came outside and officers continued to order him to put his hands in the air and give up. They told him everything could be worked out. Corkery was reported to have mouthed, "There's nothing to work out."

Several responding officers and bystanders reported that Corkery had what appeared to be a gun in his hand. Officers fired when Corkery began to raise the gun upward, stating they feared for their safety and the safety of others in the area.

The Prosecutor's Office has determined that the officers' actions were justified and no criminal charges will be pursued since it was reasonable to believe the officers were being threatened with deadly force and to answer with deadly force.

Troopers responded to Chase Road, west of Rathdrum, around 1:15 p.m. Investigators say 20-year-old Brady Robert McPhail of Osburn, Idaho, was traveling eastbound in a white 2010 Buick Lucerne when he went into the westbound lane of traffic.

Investigators say 26-year-old John L. Scott of Lancaster, Pennsylvania,  was headed westbound on SR 290 east of Flora in a 2012 Toyota Tacoma pickup when he crossed the center line into the oncoming lanes of traffic.
