GAINESVILLE, Ga. -

Police in Georgia arrested a 20-year-old father after he and his 3-year-old son were found drunk. Marcus Daniel Allen and his son were found Saturday night by family members.

Allen was unconscious. Nearby was his drink, and his 3-year-old son. Family members took the two to the hospital and when Allen woke up he tried to escape the hospital and run, but officers easily caught up with him in the parking lot.

The child's blood alcohol content was twice the legal limit for an adult, which is nearly fatal for a 3-year old.

Officers said the "juice form, mixed drink" was in a large cup with a straw making it easier for the child to drink from the same cup.

"I think it could have been a lot worse had they not come home when they did. Had the child ingested more alcohol, it could have been fatal," Deputy Chief Jay Parrish from the Gainesville Police Department said.

Allen is now in jail. He's charged with a felony count of Child Cruelty and because he's only 20, he was also charged with Alcohol Consumption by a Minor.

The boy has been returned to his mother according to authorities..
