New report from Sheriff's Office says imprint of Ryan Holyk's hat on bumper of deputy's car

SPOKANE VALLEY, Wash. -

In the fifth review of the case, Sheriff Ozzie Knezovich says a new report by one of his investigators shows an imprint from Ryan Holyk's hat on the bumper of Deputy Joe Bodman's patrol car. 

Dr. Jarrod Carter found evidence that the hat Ryan was wearing at the time of the crash left an imprint in the same area that Ryan's DNA was found on the bumper. 

"It indicates very clearly that the bumper did in fact hit Holyk's head," Dr. Carter said in a press conference on Wednesday. 

The Spokane County Prosecutor's Office says they will be taking "another look" at the case, in light of the new evidence. 

Holyk died in June, 2014 after he crashed on his bicycle on May 23 in Spokane Valley. Spokane Valley Sheriff's Deputy Bodman was responding to back up another deputy who was not answering his radio. Bodman was traveling at a little over 70 mph in a 35 mph zone and did not have lights or siren on.

Holyk was riding a BMX bike at the time. He was not wearing a helmet and his bike had no brakes, lights or reflectors. As Holyk approached an intersection, a witness saw him pop a wheelie and proceed into the intersection against a red light. 

According to an investigation and three different accident reconstructions by the Washington State Patrol's Major Accident Investigative Team (MAIT), Spokane Police Department, Spokane Investigative Regional Response Team (SIRR) and Forensic Video Solutions, Inc., it was concluded that Holyk was not hit by Deputy Bodman's vehicle.

Bodman braked and swerved to the right missing Holyk, but coming as close as one foot. They also concluded that Holyk turned his handlebars hard to the right, causing him to stop suddenly, go over his handlebars and hit his head on the pavement, causing the injuries he later died from.

Questions were immediately raised after the crash as to whether or not the patrol car struck Holyk. Holyk's DNA was later found on the patrol car.

Multiple investigations since the incident concluded that Deputy Bodman never made contact with Holyk and he simply fell off his bike without a helmet and that's what caused his death. Since then, the Holyk family filed a lawsuit against Spokane County, and there have been calls for further investigation into the incident, including from local motorcycle club founder Scott Maclay, who believes it was a cover up and even at one point sparked concern from the Sheriff's Office by advocating people to throw teal volleyballs at patrol cars in memory of Ryan. 

In January 2015, the Spokane County Prosecutor's Office reviewed the case and decided they would not press charges against Deputy Bodman.
