After days of delay and bickering on all sides, a judge finally released the body of Summer Phelps so her biological mother could give her a proper burial. The couple charged in her death withdrew a request for a second autopsy.
Summer, just 4-years-old, died March 11, 2007 after reportedly being forced to spend 10 hours in a bathtub as punishment.
The girl's biological father, Jonathan Lytle, and stepmother, Adriana Lytle, are both charged with homicide by abuse. A medical examiner has yet to give a specific cause of death.
Investigators say bruises on the little girl and statements from the parents show she was subject to abusive discipline that bordered on torture.
Defense lawyers sought to have a second autopsy, but now say they'll hire an independent forensic pathologist to review the autopsy report.
