Duncan's defense attorneys: court sealing too much

BOISE, Idaho. - Defense attorneys for convicted child killer Joseph Edward Duncan III say a federal judge is being overzealous in sealing court documents connected to his death row sentencing case.

In a court document filed Tuesday, Duncan's defense team asked U.S. District Court Judge Edward Lodge to open a status conference to the public and limit the number of documents filed under seal. The attorneys contend that the closures are violating Duncan's right to a public trial and the public's right to access.

Several news organizations, including The Associated Press and The Spokesman-Review, have filed a lawsuit intended to keep the case open to the public.

Duncan, a convicted pedophile from Tacoma, Wash., pleaded guilty in December to 10 federal charges related to his 2005 kidnapping of two young siblings, Dylan and Shasta Groene, and the murder of Dylan. The children were snatched from their northern Idaho home after Duncan fatally bludgeoned the children's mother, Brenda Groene, their 13-year-old brother Slade, and the mother's fiance, Mark McKenzie.
