Eleven-year-old girl accused of soliciting prostitution

SPOKANE, Wash. - A Spokane Valley couple is incensed, saying their 11-year-old daughter is accused of soliciting prostitution.

Tommy Marks and Sandy Steve say the alleged incident of soliciting happened nearly three years ago at the Spokane Valley Rosauer's.

According to court documents two men allege they were approached by a young girl while sitting in the deli. The girl allegedly asked the men some questions. One of the men states it appeared as if the girl was trying to get a 'date' and reported this belief to a Rosauers employee. For a complete recount what transpired according to Rosauers, click on the memorandum to the right.

Tommy Marks and Sandy Steve say following the alleged incident, a security guard at that store detained their daughter and locked her in a room refusing to let her see her mother and her aunt.

The couple is suing Rosauer's for an undisclosed amount of money, but they say this is not about the money and they feel there will never be justice. They say their daughter has suffered from mental anguish since the incident and is currently undergoing counseling.

Tommy Marks feels he is being unfairly stigmatized because of his family name. The Marks family settled a civil rights lawsuit with the city of Spokane for $1.4 million.

Earlier, Rosauer's released this statement: "Rosauers believes in the due process of the justice system. Trying the case in the public arena where all facts have not been disclosed is unfair to all the parties involved. While KHQ has chosen to air the plaintiffs' position, we believe the publicly sworn affidavits and corroborating video, when presented in Court, will invalidate the accusations that have been made against Rosauers."

Rosauer's lawyer, Michael McFarland, says they stand behind their opinion that the girl was propositioning elderly men at the store. They sent us copies of the affidavits of several men who were allegedly propositioned. Those can be viewed by clicking the links to the right.
