Witness says he watched Capone murder estranged wife

In a Latah County courtroom on Wednesday, David Stone was sentenced for playing a role in the murder of Rachael Anderson. Anderson went missing more than four years ago her body has never been found. Stone agreed to a plea deal in exchange to testify against Charles Capone at his murder trial. Capone is the estranged husband of Anderson. Stone told the court he didn't kill Anderson but witnessed Capone strangle her then he helped him wrap up her body in a tarp and throw her in the Snake river from the Red Wolf bridge.

In court on Wednesday, David Stone told the judge, "I am sorry everyday for what I did. Through visiting with pastor Charlie and other followers of Christ both before and after my incarceration I have had a lot of time to reflect to do the right thing a long time ago."

Rachael Anderson's oldest daughter Amber Griswold also spoke to the court saying, "his decision to not come forward and to keep quiet, it cost a lot of time, money and suffering over the years. Just looking, searching, wondering and waiting."

Stone said he did not speak up sooner because he feared Capone may kill him too.

David Stone has spent 18 months in jail already and will get credit for time served. He was sentenced to no less than 3 years and no more than 7 years in prison. He pleaded guilty to not reporting a dead body to authorities. Charles Capone will be sentenced for Anderson's murder in January, 2015.
